So theres this man who Lives in the country he decides to rent a BIG cat machine for work round his property. Tells the wife lock the kids in and dont come out...in fear of someone getting hurt. U cant even see the neighbors property and they havent visited in a year. Works outside most of the day until his son & step daughter tell their mother MOM!! Someones under that machine!!! Mom runs outside to find neighbors 4 yr old literally under the machine. The dad(operating the machine) who wasnt high or drunk never noticed the little girl. There was a 17 boy hired to watch out after the girl...whos at fault?
Equipment operator. If u have blindspots while u are running it then it is ur responsability to have a spotter
That's a tough one. Honestly I think everyone is a little at fault. But as the parents of the little girl, I would be more upset with the 17 year old who was supposed to be watching my daughter, and myself for not knowing that the 17 year old was not responsible enough to watch her.
Wow! now thats somethin to think about....im sure if that was my daughter id feel like i was to blame....bcuz above all its my job to make sure whoever is with my kids when im not is responsible enough to keep them safe....but im sure id be angry at the world for that....but i say babysitter 1st....what could they have been doin to not notice she was missing?
I hope this didnt really occur or it really doesnt matter whose fault. Tragic no matter what.
Legally the property owner and CAT operator is ultimatly resposible! So clearly the father is at fault, from a legal standpoint.

I dont know. The guy locked up his own kids to keep them safe. Legally wouldnt osha say that was acknowledging an unsafe site
yes, I would thing so, its difficult to ascertain from the limited amount of detail in the Op's post.
Legally its the babysitters fault. Think about it. Theoperator locked his own kids u. If the baby stter did there job it would not of happend. Blind spots or not. He had the basic pecoutions to protect thoe around him. The baysitter for neglagence.
For children that small of and that young you have to watch all the time because they wander and get ahold of stuff. Here when the use big machinery they put a temporary fence around the area so people dont get into the site. So im not sure who would be responsible.
