That was the first thing I thought about, Why did the parents not throw a fit? I know I would have
I wld have, at the least, say a year later, been asking where the guy was.

Would you really have made sure though?
I wondered, for years, what the driver that hit my kid was doing, js.

Hell yea I would have made sure! That is something you don't just forget or I would have took the law into my own hands. Should he have turned himself in? Yes he should have, but he didn't so why did he not get picked up?

One of my first questions was-why was the baby unrestrained? Could the parents have prevented the baby from bein thrown out the window? An accident is just that-but not restraining your child in a vehicle is a choice... Also I do think the parents should have been more aware of his incarceration. I still call the prosecuter from time to time to make sure the bit.ch that killed my brother is still in Nashville Womens Prison. When she appeals, they notify me. Its a tragedy that could have been avoided had both parties been following the law. Assuming back then there were child restraint laws... if the state messed up by not makin him serve his given time its on them.

@SweetNothings: Im not dismissing the fact that he should have been punished for what he did. I just think that obviously it did affect him to the point of rehabilitation, and truly the only thing he could possibly do to make them feel vindicated would be for him to die or bring the child back because two years for a life is ridiculous to begin with. That being said, I think it would be futile and a waste of taxpayers money to punish him now.

The state in the original case dropped the ball on this one for sure! And back in the late 90's seatbelt laws were just being initiated for children. The state should have made sure he served his time back then n. Now after almost twenty years the state all of a sudden says hey u r gonna serve ur sentence now even though we forgot to make sure u were locked up twenty years ago, something is realy wrong here! If the guy in question is still living in the same area all this time why didn't the police go get n put in jail to serve his time? Why wait this long to put him in jail?

Only if he confesses and pleads guilty do I think he should get supervised probation and restitution. Its the states fault for not prosecuting it in a fair and timely manner, althou I do believe he should have turned himself in much sooner. Must not have been any victim impact consideration at that time cuz you'd think the family wouldn't let that slip thru the cracks. How sad for everyone involved.

Hr shld be left alone...no probation or jail time. It is twenty years later and he was 19. Kids use bad judgement and that a baby died is horrible but life does go on. And today the other driver wlda have been charged with negligent homicide because the baby was unrestrained...do we go back and charge the other driver 20 years later?
